On August 27, 2003, the child was a passenger on a school bus that left the roadway, traveled down a steep embankment adjacent to the roadway, and rolled over.  The child, who was twelve years old at the time of the bus crash, suffered permanent brain damage, paraplegia, orthopedic injuries and other multi-system injuries.

Medical Malpractice

Axelrod & Associates was successful in negotiating settlements with a hospital and a pediatric urologist amounting to over $10,000,000 in lifetime payments for a young child for his medical malpractice claim.  The settlement with the hospital was reached during the discovery phase and the settlement with the urologist was reached after the first day of trial.

Commercial Litigation

Axelrod & Associates rescued a regional industrial demolition company by assisting the company in recovering $1.3 million from the owner of a large chemical plant the company had demolished in the Chicago area.  Many of the issues involved were unique to the demolition industry, an area in which the firm has substantial experience.

Axelrod & Associates successfully represented clients whose trade secret customer information had been stolen, initially obtaining an injunction preventing use of that information and, ultimately, winning at trial an award of compensatory damages for business loss as well as punitive damages.  After trial, while the court was to decide the amount of attorneys fees to be awarded, the case was settled in favor of the firm’s clients.

Commercial Litigation and Fraud

Axelrod & Associates was successful in obtaining a settlement of a multi-million dollar mortgage fraud case on behalf of its client, a wholesale residential mortgage lender in the secondary market.  The settlement took place just as the parties were about to start trial and was the result of years of diligent work by the law firm.

Medical Malpractice and Wrongful Death

David A. Axelrod & Associates procured a $2.1 million settlement for the mother and sister of a 23 year-old man who died by suffocation while a patient in the intensive care unit at a Chicago area hospital.  The settlement was paid by the hospital as well as by the insurance company for an anesthesiologist who failed to properly reintubate the patient when he encountered the profound breathing problems that led to the young man’s death.
